Minister admits that SANRAL’s measuring instruments are still illegal

Years after being implemented and utilised, the measuring instruments of the e-toll system are still not certified as required by the Legal Metrology Act 9 of 2014 and therefore their use is illegal, says adv Anton Alberts, chairperson of the FF Plus.

In an answer to a written parliamentary question regarding the matter, the minister admitted that thus far only interim standards have been developed and that the instruments are currently undergoing evaluation to test compliance. (Please see question and answers below).

According to adv Alberts, this means that the instruments have been illegally in use for more than two years now since the FF Plus first confronted SANRAL about the fact that its instruments are not certified.

The answer is astounding seeing as it means that above and beyond all the other illegal aspects as pointed out by OUTA, the e-toll system is still technically non-compliant in terms of the Legal Metrology Act.

“SANRAL can therefore not prove that any bills issued by them are correct and can serve as evidence in a court.

“The question of how long it will take to finally certify the instruments remains unanswered. In the interim the sustainability of the system is in doubt and the FF Plus is once again calling on the government to completely abolish the entire system.

“A temporary levy on the petrol price can settle the debt of upgrading Gauteng’s roads,” says adv Alberts.

(1) Whether the National Regulator for Compulsory Specifications has already developed specifications for the instruments of the e-tolling system in Gauteng; if not, (a) why not and (b) on what legal basis are the instruments currently being applied; if, so,
(2) Whether the instruments have already been tested regarding compliance with the specifications; if so, where can the report be found
REPLY
(1) Interim requirements have been developed and accepted by the acting CEO of the National Regulator for Compulsory Specifications in accordance with Section 22 (2) (c) of the Legal Metrology Act. The remainder of the question is therefore not applicable.

(2) The system is currently undergoing type approval evaluation in accordance with the interim requirements.
