The FF Plus in the Tshwane Metro Council insists that the decision by the South African Local Bargaining Council (SALBC) to reinstate five officials implicated in tender fraud be reviewed.
The Metro’s former government, of which the FF Plus was part, suspended the five officials in question. This decision was based on a comprehensive and independent investigation which recommended that disciplinary action be taken against the officials.
The forensic investigation found that the officials committed several offences in awarding a tender to upgrade the Rooiwal Wastewater Treatment Plant to Edwin Sodi – a known donor and supporter of the ANC.
The FF Plus questions the Bargaining Council’s ruling that the officials were unlawfully suspended.
The FF Plus is of the opinion that the recommendation by the Special Investigating Unit (SIU) and the National Prosecuting Authority (NPA) that the officials be criminally prosecuted should be upheld. It substantiates the forensic report’s findings.
The party has already requested the City Manager, Mr Johann Metler, to take the Bargaining Council’s decision under review.
Besides, the case against the officials first needs to be tested in the Labour Court before the Bargaining Council’s decision can be upheld.
Allegations of tender fraud are serious and reinstating these officials could result in tampering with evidence.
It also communicates to other offenders that they are free to continue with their unlawful practices with impunity.
