There must be no more delays in addressing the ongoing air pollution at Elmadal in Limpopo.
The province's MEC for Economic Development, Tourism and Environmental Affairs, Mr Rogers Monama, must see to it that the municipal report on alleged illegal activities conducted on a smallholding in Elmadal is disclosed to prevent legal action.
These smallholdings are zoned for agricultural and residential purposes only.
The drawn-out situation resulted from the failure of the Polokwane Local Municipality (Pietersburg) to conduct the relevant investigations and provide a report to lawyers who are handling the case on behalf of residents.
The supposed development of an illegal brickworks on one of the smallholdings in the area and the accompanying air pollution have upset residents greatly and compelled them to take legal steps.
In February 2023, the local bailiff issued a cease-and-desist letter to the owners of the illegal establishments.
Residents are particularly concerned about the air pollution caused by the cement-brick manufacturing process. A fine powder is released into the air, which can cause serious health issues in the long term.
The FF Plus is in possession of the legal letter dated 23 February, addressed to the manager of the Municipality's legal division, Mr Reuben Maleta.
In it, the firm points out that the Municipality's grace period of seven days to complete and deliver the inspection report has lapsed.
Among other things, a request was made to Maleta to ensure that an inspection of the smallholding is conducted seeing as it will determine the possible legal action to be taken.
In the meantime, on 13 March, the party also lodged a complaint with the Human Rights Commission (HRC) on behalf of concerned Elmadal residents who had approached the FF Plus.
In terms of the Constitution, everyone has the right to an environment that is not harmful to a person's health or wellbeing.
The FF Plus will monitor the progress of the matter and act in residents' best interests.
