The Freedom Front Plus (VF Plus) is concerned about the proposed amendments to the City of Cape Town’s Municipal Planning By-law of 2026. These amendments undermine transparency and meaningful public participation.
It also unfairly saddles residents with a responsibility that the City is actually meant to shoulder.
Public participation in Cape Town already falls short and is often regarded as a mere formality. Instead of increasing transparency, the new provisions shift the burden of monitoring and understanding complex legislation onto the public.
The Freedom Front Plus is particularly concerned about the new section 95A, which stipulates that residents are deemed aware of any approved building plans seven days after its publication on the City’s website.
This is impractical and unacceptable, as it diminishes the City’s obligations and forces the public to continuously monitor municipal publications.
In addition, the simplification of the definition of an “abutting owner” and the strict time limits for access to information pose a serious threat to community organisations. These organisations play a key role in protecting neighbourhoods against uncontrolled development, traffic congestion and the loss of neighbourhood character.
By restricting their access to information and objection mechanisms, the community’s voice is silenced.
The brief public consultation process on the amendments, which spanned a mere two weeks during the school holidays, is unacceptable. It clearly demonstrates that the City is not genuinely interested in gaining meaningful input from the public.
The Freedom Front Plus calls on the City of Cape Town to reconsider these amendments and to ensure that the public participation process is transparent, inclusive and credible. The future of urban planning and public trust depend on it.
