NERSA ruling: Protect Free State residents

The Free State municipalities that unlawfully implemented tariff hikes should indicate whether steps will be taken to compensate residents for the unlawfully imposed higher tariffs.

The FF Plus submitted questions to all Free State municipalities, calling all municipalities which did not comply with the relevant regulations to account for how residents will be compensated.

In terms of the court order stemming from AfriForum’s application against NERSA in June this year, only Letsemeng, Setsoto, Nketoana, Tswelopele, Moqhaka, Mohokare and Centlec in Mangaung may impose higher power tariffs for the current financial year.

The order by the Pretoria High Court and NERSA’s unsuccessful application for leave to appeal prohibit the other thirteen municipalities from implementing power tariff hikes.

The FF Plus, furthermore, demands that the guilty municipalities indicate what action will be taken against officials who did not comply with the regulations.

The FF Plus posed the same question in the Free State Legislature to the MEC for Cooperative Governance and Traditional Affairs (COGTA), Mr Saki Mokwena.

The time has come to hold municipal officials who fail to comply with legislation and regulations accountable, and to protect the rights of Free State residents.
