FF Plus supports Constitutional Court’s ruling that new home owners are not liable for historical debt

The FF Plus supports the Constitutional Court’s ruling that new home owners cannot be held liable for historical municipal debt and considers it a case where reason and justice triumphed over mismanagement and unfair practices in local government, says Adv Anton Alberts, chairperson of the FF Plus.

According to Adv Alberts, there were no grounds on which local councils could hold new land-owners liable for the outstanding debt of the previous owners.

He says that the ruling also affects councils where coalitions are currently in power and have to bear the heavy burden of debt due to the fact that the ANC previously mismanaged the municipality.

“Despite the fact that the ruling in effect closed the money tap for the new local governments that are trying to remedy the administration of the cities concerned – also where the FF Plus is part of the coalition – the party believes that the finding is rational and reasonable.

“The residents of every town and city must be put first and coalitions will simply have to find other creative and reasonable ways to relieve the city councils’ burden of debt and remedy the administration,” says Adv Alberts.
