Suspensions: Gauteng MEC for Cooperative Governance acted outside of the scope of his authority

 The Gauteng MEC for the Department of Cooperative Governance and Traditional Affairs (COGTA), Lebogang Maile, has acted out of order by suspending the former Speaker of the Johannesburg Metro Council, Vasco da Gama, and the Speaker of the Tshwane Metro Council, Katlego Mathebe, for six months without pay.

 Maile violated the rules of natural justice, as enshrined in Section 7 of the Municipal Structures Act, by not first launching an investigation after all the remedies within the respective metro councils had been exhausted. Only a correspondence was carried out.

 

The FF Plus wants the MEC to explain why he did not intervene at the Mogale City Municipality where the recently deceased Mayor, Patrick Lepudi, had filled the mayoral position in an unconstitutional manner since 2017 and where the council is functioning without rules of procedure.

 

The MEC is making a party-political playball of local government by only intervening at municipal councils where the ANC does not have the majority. His actions are irresponsible and being an executive official, he is violating his own ethical code of conduct. He is also creating a precedent that will deliver a severe blow to service delivery.

The FF Plus, as former coalition partner in Mogale City and Johannesburg and currently in the Tshwane Metro, will put pressure on the MEC to act within the rules of natural justice and will also launch an investigation into the matter.
