{"id":88153,"date":"2026-05-08T14:32:50","date_gmt":"2026-05-08T12:32:50","guid":{"rendered":"https:\/\/www.vfplus.org.za\/?p=88153"},"modified":"2026-05-08T14:32:54","modified_gmt":"2026-05-08T12:32:54","slug":"vf-plus-kommer-oor-grondwethof-se-phala-phala-beslissing","status":"publish","type":"post","link":"https:\/\/www.vfplus.org.za\/af\/jongste-nuus\/vf-plus-kommer-oor-grondwethof-se-phala-phala-beslissing\/","title":{"rendered":"VF Plus-kommer oor Grondwethof se Phala Phala-beslissing"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Die VF Plus verwelkom vandag se Grondwethof-uitspraak oor Phala Phala, maar is bekommerd oor die feit dat hof met sy uitspraak tot \u2018n mate die skeiding van magte erodeer deur aan die parlement voor te skryf oor hoe om sy interne prosesse te bestuur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die hof het beslis dat die onafhanklike paneel se verslag, wat bevind het daar bestaan \u2019n prima facie-saak van ernstige skending van die Grondwet of wet deur pres. Cyril Ramaphosa, wel na \u2019n parlement\u00eare komitee verwys moet word vir verdere ondersoek.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die bestaande re\u00ebl, wat vereis dat die Nasionale Vergadering (NV) eers moet stem oor \u00f3f so \u2019n verslag na \u2019n komitee verwys moet word, is daarom ongrondwetlik.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die stemming in Desember 2022 (waarin die ANC-meerderheid met 214 teen 148 gestem het om nie die saak te ondersoek nie) val dus weg wat hierdie saak aanbetref.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die Grondwethof se uitspraak impliseer daarom volgens die VF Plus dat die hele Artikel 89-proses (die verwydering van die president) vereenvoudig moet word.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dit beteken dat die onafhanklike, deskundige artikel 89-paneel wat eers moet ondersoek of daar \u2019n prima facie-saak is, oorbodig of oortollig is.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In die toekoms kan \u2019n mosie van verwydering direk n\u00e1 \u2019n volle parlement\u00eare ondersoekkomitee gaan sonder dat \u2019n voorlopige artikel 89-paneel dit hoef te ondersoek en sonder dat die NV eers hoef te stem oor \u00f3f so \u2019n paneel se verslag ondersoek moet word.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die hof het daarom nie net bevind wat moet gebeur nie, naamlik dat die Phala Phala-verslag ondersoek moet word, maar ook ho\u00e9 die proses in die toekoms moet verloop.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die VF Plus is hieroor ongemaklik. Die hof tree te veel in die domein van die wetgewer (parlement) in deur prosedure voor te skryf.
