{"id":83559,"date":"2025-10-17T10:03:24","date_gmt":"2025-10-17T08:03:24","guid":{"rendered":"https:\/\/www.vfplus.org.za\/?p=83559"},"modified":"2025-10-17T10:03:30","modified_gmt":"2025-10-17T08:03:30","slug":"mkhondo-minag-hofbevel","status":"publish","type":"post","link":"https:\/\/www.vfplus.org.za\/af\/mediaverklarings\/mkhondo-minag-hofbevel\/","title":{"rendered":"Mkhondo minag hofbevel"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Die VF Plus beskou die Mkhondo-plaaslike munisipaliteit (eMkhondo (Piet Retief), eMvelo (Amsterdam)) se volgehoue minagting van \u0149 hofbevel van 30 Mei 2025 as kenmerkend van \u2019n instansie wat totaal wanfunksioneel is en nie binne die raamwerk van die wet opereer nie.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hierdie bevel van die hooggeregshof in Mpumalanga bevestig die oorspronklike hofuitspraak van 14 Februarie 2024, wat die invordering van eiendomsbelasting vir die boekjare 2009\/2010 tot 2018\/19 verbied weens die nie-publikasie van die tariewe in die Mpumalanga provinsiale koerant soos die Wet op Munisipale Eiendomsbelasting vereis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die hof het ook gelas dat klaringsertifikate ingevolge artikel 118 van die Munisipale Stelselswet uitgereik word volgens voorgeskrewe prosedures, met bykomende vereistes vir billike tarieftoepassing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Agri Piet Retief, wat die saak namens grondeienaars gebring het, het bevestig dat die hofbevel van 30 Mei 2025 per hand op 11 Augustus 2025 aan die munisipaliteit oorhandig is, maar dat nog geen gehoor daaraan gegee is nie.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die versuim om aan die hofbevel gehoor te gee, kan daartoe lei dat amptenare van die munisipaliteit skuldig bevind word aan minagting van die hof.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die party beskou hierdie voortgesette nie-nakoming as \u2019n verbreking van die oppergesag van die reg en \u2019n onreg teenoor grondeienaars.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die VF Plus het \u0149 beroep gedoen op Mpumalanga se provinsiale regering om in te gryp en die munisipaliteit se nakoming van die hofbevel af te dwing en om ondersoek in te stel na amptenare se moontlike minagting van die hof.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hierdie saak gaan oor regverdigheid, aanspreeklikheid en die handhawing van wet en orde in plaaslike regering.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Die VF Plus beskou die Mkhondo-plaaslike munisipaliteit (eMkhondo (Piet Retief), eMvelo (Amsterdam)) se volgehoue minagting van \u0149 hofbevel van 30 Mei 2025 as kenmerkend van \u2019n instansie wat totaal wanfunksioneel is en nie binne die raamwerk van die wet opereer nie.
