{"id":78675,"date":"2025-02-19T12:22:18","date_gmt":"2025-02-19T10:22:18","guid":{"rendered":"https:\/\/www.vfplus.org.za\/?p=78675"},"modified":"2025-02-19T12:22:35","modified_gmt":"2025-02-19T10:22:35","slug":"politieke-partye-verspeel-gulde-kans-om-na-grondwethof-te-gaan-oor-onteieningswet","status":"publish","type":"post","link":"https:\/\/www.vfplus.org.za\/af\/jongste-nuus\/politieke-partye-verspeel-gulde-kans-om-na-grondwethof-te-gaan-oor-onteieningswet\/","title":{"rendered":"Politieke partye verspeel gulde kans om na Grondwethof te gaan oor Onteieningswet"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Politieke partye soos die DA en IFP het \u2018n gulde kans verspeel om saam met die VF Plus te staan om in gevolge artikel 80 van die Grondwet die Grondwethof direk te nader om die grondwetlikheid van die Onteieningswet te toets.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Artikel 80 van die Grondwet bepaal dat ten minste een derde van die lede van die Nasionale Vergadering (NV) by die Grondwethof kan aansoek doen om \u2018n bevel te verkry dat \u2018n parlementswet in sy geheel of ten dele ongrondwetlik is.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die VF Plus het verlede maand al die tersaaklike partye genader en was sedertdien in voortdurende gesprekvoering om hulle te oorreed om die geleentheid aan te gryp wat die Grondwet aan partye in die NV bied om aanvegbare wette te betwis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Artikel 80 is as beskermingsmeganisme juis met daardie doel in die Grondwet geplaas en met die hulp van ander partye sou dit wel moontlik gewees het om op hierdie wyse toegang tot die Grondwethof te kry. Dit sou ook \u2018n baie kragtige eenheidsboodskap vanaf die politieke gemeenskap dra.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dit is jammer dat hierdie geleentheid nie gebruik is nie. Al die verskillende regs- en politieke we\u00eb moet gevolg word om die gewraakte bepalings van die wet te stuit, maar partye moet waak daarteen om hierdie belangrike aangeleentheid slegs te gebruik om kiesers te be\u00efndruk en daarom nie alle moontlike uitwe\u00eb te volg nie.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Die VF Plus sal nou as volgende stap self die Grondwethof direk nader. Die party volstaan by sy siening dat die bepalings in die wet ten opsigte van nul vergoeding ongrondwetlik is.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dit hou nie net ernstige gevolge in vir Suid-Afrikaners wat eiendomsreg aanbetref nie, maar stuur ook \u2018n uiters negatiewe boodskap na die internasionale gemeenskap soos duidelik gesien is met pres. Donald Trump van die VSA se uitlatings oor onteiening in Suid-Afrika.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Beleggers sal moeilik oortuig word om in \u2018n land te bel\u00ea waar hul eiendom sonder meer vervreem kan word.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Almal in Suid-Afrika en in enige demokratiese bestel het die reg om eiendom te besit en die staat het geen reg om dit te onteien sonder markverwante vergoeding nie.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Politieke partye soos die DA en IFP het \u2018n gulde kans verspeel om saam met die VF Plus te staan om in gevolge artikel 80 van die Grondwet die Grondwethof direk te nader om die grondwetlikheid van die Onteieningswet te toets.
